Congratulations on your GC. Yes, tell your sister to send you the GC by mail. Once you get it, you can get back into the U.S. using your GC. I know few people who have done this. Good luck.

its depends ...
1) my and wife air ticket to india for visa stamping.
2) All visa fees
3) all hotel exp.
4) All attorney and USCIS fees .
but check with your CPA .
Jeezz.. travel to India? Is this personal or business travel? If business didn't you get paid for international travel?
I guess everything related to conducting your business can be itemized as tax deductable.

please see below.
Background:
My wife and I are currently working on EADs obtained through my previous employer filing for my green card (eb3 India, pri date: dec 2005), my wife is a dependant on this greencard petition. We last re-entered US using our AP. Two years ago, more than six months after my I-140 got approved, I changed my employer (to a similar position in the IT field itself) and my new (and current) employer filed for AC-21. They have also obtained a I-797 for me as a backup which I have used. Also prior to getting my EAD, my wife worked on an H1 visa for a year and then we got EAD, she has been working on that ever since. Our EAD was recently submitted for renewal and will be valid for the next two years.
I got accepted into a fulltime MBA program in the US, which I am planning to attend. This would mean that I quit my current job and after the two years in MBA I will be joining a different employer in a different field (ie: I will be moving out of IT into something like finance). I am assuming transition to F1 is out of question since I have shown immigration intent
Questions:
1) Will it be legal for me to go fulltime to school on an AOS pending status? Yes you can go to school while in AOS. But you cant go to school full time when in AOS if you are the primary applicant. You need to be still employed full time in your line of work.
2) Will I have trouble, re-entering the US on an AP if I travel overseas during the time I am enrolled in school? Yes. Your AP is no longer valid, as you are no more working for the sponsor of your permanent residency.
3) Can I use this EAD card to go for an internship between my first and second year (the job will not be IT)? Only if you are a dependent of the primary applicant.
4) Can I use this EAD card to work fulltime after MBA graduation, provided it is still valid for a few more months (the job will not be IT)? Only if you are a dependent of the primary applicant.
5) If my post-MBA employer files for a greencard for me in the new position which is different from IT, will I be able to use my old priority date of Dec 2005? Yes you can. You will need to file a new labor, and request that they use the old priority date. You can also file in EB2 and request they use the EB3 filing date of Dec 2005.
6) To mitigate risk, my wife is planning to go into H1 so that I can get an H4 if going to school on EAD doesn't work. Is this strategy to use H1 during school time (and travel overseas and re-enter using H4) and use EAD while internship safe? Using H1 on your wife, and you being on H4 is safe. But you cannot use the EAD anymore. Your EAD is tied to your employment, unless you are the dependent on the primary applicant for AOS.
7) If my wife cannot find a H1 job, can she work on her EAD while I am also using EAD to go to school. No. When you quit working and go to school, both of you are in illegal status. To remain in status, she either needs to convert to H1 or you need to convert to F1 and have her here as F2. Best bet, is for her to convert to H1 and you to either H4 or F1.
8) I am assuming that for any EAD based status to work, I need to have a future job offer in the same category. My current employer will not do that.I can get a future job offer from a small IT consulting firm in the same IT field for which my greencard application was filed for. Will that be good enough to keep my EAD alive while in school? No. For your EAD to be valid, you still need to be working. Stopping work does not enable you to continue to be in EAD status.
Thanks SO much for answering. I have this wonderful opportunity in front of me and I really hope immigration will not be a road block to achieve my dreams.

Crystal ball gazing ........
Everyone wants us to put on our genies hat, gaze into our crystal ball, and try to predict what is going to happen in the next few months. So here it goes
Congress is set to debate CIR in May. HLG thinks that there is a reasonable chance that one house of Congress passes CIR in the May/June time frame. And that the other house of Congress passes another CIR in June/July. With some negotiation, a compromise CIR bill could be on the presidents desk by the middle of the summer say July.
In addition, we are also actively courting the bridge legislation that weve mentioned many times. HLG was privy to a meeting that took place just this week with a senior staffer in an important Senators office. The challenge here is to find the right must-pass legislation that can serve as a host.
Putting this all together HLG is slightly raising our latest estimate. Were willing to print that there is a 60% chance that either CIR or Bridge legislation is passed and signed by the President by August 1. Whenever a bill is passed it will likley take an additional 30-60 days before the first visas are issued.

I watch anxiously hoping they might mention somewhere for atleast for 10 sec about legal immigrant...but they never...!!!Jsu tjsut keep mentioning about illigal immigrants whole hour of the show.
Even our efforts to spread the hardships of legal immigrants gets washed out in the big noise on illegals.
Like we did in the rally, we have to specifically and forcefully mention that we are legals. Only with our efforts that the American public and the politicians will start noticing about this neglected section of legal immigration.

Please refrain from saying such a thing for President.
He might have made mistakes but he has been a tough one for terrorists.Since Sep11,2001,he has kept the ppl safe.
6 years is a big time.
If he is trying something beneficial for Immigrants, lets support him and ask him to support our cause.
I think we should send faxes/emails to him to show our support and I am sure he will get our amendment passed.
Lets give this a try.I am sure he will make no more mistakes as these are some last things which can give a lot of credibility back to his Presidentship.

Thank you for sharing the boat. Although, it is better than being lonely, I don't want anyone in this dilemma.
I hope we both get ours soon, hopefully by EOD today as other poster was wishing.

this is in response to some who say what if India does this and that ...the point is that India will do nothing. In general we have passive leaders and our PM is a great example of that - if it was done against china then immediately there would have retaliation. in some ways it is good if it stops the misuse ...I guess the biggest losers in this are the lawyers - more lawyer shops will close down
you got it dude .. just imagine , we are trying to dictate laws in some other country and blame law makers in the US ( senators , congressmen) , but all this things happen in India , we just accept the fact and move on .. so just accept the fact and move on , we cant do anything about it , as far as politicians are concerned in India , they do what they want classic eg is Kalmadi who has been taking bribes from God know when , you guys know rite

United Nations, Pls help Immigration Voice.
we know your capability.
BTW, sorry for some members rude behaviour towards you.
Probably they may not know about your role in
immigrationportal.com and they may not even know how you helped lot of guys with I140 ability to pay issues.
Hi Guys, pls encourage good people like United Nations to help us.
He will be good asset for us to utilize his time and service.
He has an amazing knowledge in immigration matters.
Need not to say, knowledge is power, in present era.
What's your point? Ok, this person is knowledgeable and has helped to answer a lot of questions, I get that. What else can he do for IV? Does he have any influence with lawmakers? Can he help us increase our fundraising? If not, he is just one regular member and therefore, you need to stop wasting time trying to focus so much attention on him.
Maybe, he is a valuable addition in terms of answering other members' questions and nudging them to contribute. Beyond that, what more can he do than what the IV core team is doing with the lawmakers? Before you waste everybody's time with multiple posts singing the praises of a person, please carefully analyze how they can benefit the whole organization. Use your brains and don't just be awed by his knowledge!

Hello Ruben,
Can you help me out on the visa? My employer had sent you an email last week to aruben@srrlaw.us with the subject name "Keerthi Shankar".
Earnestly waiting for your reply.
Thanks.
Hi Keerthi,
I would be happy to help. I don't recall getting an e-mail from your employer last week. It is possible that it ended up in a spam folder. Could you ask your employer to resend today and i will be on the lookout for it.

First and foremost we are a nation of laws, or as we are all anticipated? But years of previous administrations have neglected the illegal immigrant problem, to the detriment of American workers.

Brittanicus,
Would you or NumbersUSA, still be so mad on illegal immigration if illegal immigrants were WHITE EUROPEANS instead of brown skinned mexian people?
Please search your soul and reply to this question honestly.

Good to see this bill and it will be great if it is passed even with less than 60% allocation from the lottery program. I don’t think they would completely eliminate lottery program and the lottery program might have their own advocacies. As mentioned in this thread they might have the lottery program for many reasons. I am hoping for the bill to pass as it is :-)
Regarding satyasrd’s question I think section 2 . line #15 thru #19 in the bill (I copied the text below) helps who obtain the advanced degree in USA before 01/05/2011 (preceding the date of the petition) and obtain the degree within 5 years you should be good to go. Chapter 2: Skills for the U.S. Workforce.
http://www.whitehouse.gov/cea/ch2-erp06.pdf
covers great deal of importance of H1B and Green Card. May be we can consider it to be part of our presentation.
Part of the report says
Caps on employment-based green cards limit the number of high-skilled
foreigners who can become permanent residents. The cap is set at 140,000
visas per year, including visas for the workers spouses and children. Each
countrys nationals can make up no more than 7 percent of total immigrant
visas. These caps have led to long delays for applicants, especially for workers
from over-represented countries. For instance, some workers who became
eligible in January 2006 for EB-2 employment-based green cards (for workers
with advanced degrees or persons of exceptional ability) had applied for
permanent residence five years earlier.
A variety of proposals have been advanced for permanent employmentbased
immigration to allow for more high-skilled workers and to reduce wait
times. Any changes to the cap on the number of employment-based green
cards would require legislative action. First, workers spouses and children
could be exempted from the cap, as is currently done for the H-1B program.
Spouses and children make up about half of the recipients of employmentbased
green cards, so this change would roughly double the number of
workers able to get employment-based green cards. Second, the fixed 140,000
cap could be replaced with a flexible market-based cap that would increase or
decrease with demand for workers eligible for employment-based green cards.
Finally, under current policy, nationals of no single country can receive more
than 7 percent of green cards. This share could be raised to reduce the long
delays for employment-based green cards for applicants from countries with
large numbers of desirable, high-skilled workers. Careful enforcement of
limits on foreign nationals access to sensitive technology would provide
continued protection for our national security.

Hi,
My I-140 approved in TSC( premium processing)
My Attorney sent my I-485 on July 2 to TSC
my labor approved from Wisconsin
but I read somewhere all applications needs to go to NSC , is it true?
I greatly appreciate your help
Lawyer says that should not be a problem. My 140 is pending in TSC, could that be a reason don't know.

To avoid being like the thread running a few days ago, I don't want to be responding to each response. However, I do want clear a few things:
I am not promoting one parenting technique over the other.
As I said, I agree with a few things and disagree with a few things the author talks about.
Having kids myself, I cannot think of a parent who would do harm to their own child. Each set of parents come with their own parenting skills that works for them and their children. I leave it at that.
I only posted this because my doc asked me of my opinion and I in turn asked the opinion of IV members. If this thread is going to turn ugly, lets stop it, that was not my intention.
